Donation agreement – definition and purpose

A donation agreement involves the gratuitous transfer of ownership rights to an asset, or the donor’s commitment to transfer an asset to the donee’s ownership free of charge. A prerequisite is that the donee accepts the gift or the offer. Both immovable and movable, as well as tangible and intangible assets, can be donated. It is possible to donate all of one’s current property, and even up to half of one’s future property. In certain cases, the agreement must be in writing, for example, in the case of real estate. Under certain conditions, a gift can be revoked due to ingratitude or financial necessity.
