
Attorney – who is it?
An attorney, also known as a legal representative or defense counsel, is a lawyer who has graduated from a faculty of law, completed at least 3 years of practice, passed the bar examinations, taken the attorney’s oath, and is registered with the Czech Bar Association. They must be insured and are bound by numerous obligations, such as the duty of confidentiality and loyalty to the client. An attorney is independent of the state.
An attorney systematically provides legal services for a fee across various fields of law. This includes representation before courts and administrative authorities, the drafting of legal documents, deeds, contracts, lawsuits, and other court filings, as well as the preparation of legal analyses and the provision of legal advice.
Some specialize narrowly in a single field, while others maintain a so-called general practice, covering all fundamental legal areas.
Practical example
An attorney may practice independently, e.g., JUDr. Marek Matěna, attorney-at-law. Attorneys may also form associations or business corporations. Some also work as employed attorneys for other lawyers.
