What is required for a divorce?

The breakdown of a marriage and the associated divorce is never a pleasant period in anyone’s life, and most people wish to have it behind them as soon as possible so they can start a new life, so to speak. Precisely to ensure that the divorce proceedings are not unnecessarily prolonged, it is advisable to know what to prepare for the divorce.

Divorce and children

If you have minor children with your spouse, it will first be necessary to decide who will be granted custody, establish a visitation schedule for the other parent, and determine child support. Without a judgment regulating childcare, the divorce itself will not be decided.

For a divorce, it is therefore necessary to agree on the method and scope of care for the common children.

Divorce and property

Most married couples own valuable assets within their community property, whether in the form of a car or real estate. It is ideal to settle these assets during the divorce, agreeing on who gets what and how much money will be paid to the other spouse in compensation.

For the divorce itself, it is not strictly necessary to agree on the division of property, but it is highly recommended.

What is required for the divorce itself?

It is sufficient to file a petition for divorce at the district court of your common residence. The court fee is 2,000 CZK. You must attach the marriage certificate to the petition.

Most often via a phone or video call. However, if the client prefers a face-to-face meeting, myself or one of my colleagues will meet them at the office. Occasionally, some clients prefer to consult the matter in writing via email.

No. In all likelihood, no one will even open the door. Since we have various meetings in different cities, we are often on the road. Many of us also work from home. It is therefore ideal to arrange a meeting via the contact form, email, or by phone.
