A – the marriage has lasted for more than 1 year

B – the spouses have not lived together as a married couple for more than 6 months (meaning they may still share a household)

C – the spouses have entered into an agreement regarding minor children, custody, and child support

D – the spouses have entered into an agreement regarding property, housing, and potentially spousal support

Which court handles the divorce?

Usually the district court corresponding to the last common place of residence of the spouses, provided that at least one of the spouses still resides there. If neither resides there anymore, the court of the spouse who did not file the petition for divorce has jurisdiction. The court fee is 2,000 CZK.
