Which form of custody is preferred by the courts?
The Constitutional Court has long preferred shared custody by both parents. In most cases, contact with both parents is in the best interest of the child. It is precisely the child’s best interest that is the most important criterion according to which the court decides. However, the objective best interest of the child may not always be identical to the subjective opinion of the child. Even in shared custody, both parents are required to pay child support, and they send the money to each other. Courts usually insist on this.
What about shared custody for young children?
The Constitutional Court has ruled that setting up shared custody is normally possible from the age of 3. The key is that the child is not dependent on the mother, e.g., through breastfeeding.
