What if the father disputes his paternity?

If the child’s father is not listed on the birth certificate and refuses to be registered voluntarily, it is first necessary to determine paternity through the court. Only then can the maintenance claim be granted. However, maintenance can be determined retroactively, so you will not lose it; it would simply be paid to you later, provided the lawsuit is filed before the child reaches 2 years of age. The court may also order the probable father to cover at least a smaller portion of the costs for childbirth, pregnancy, and the mother’s maintenance even before paternity is determined. In court, it is then necessary to prove the probability of the father’s paternity.

How high is the maintenance for an unmarried mother?

The amount of maintenance is always individual. The court assesses the financial circumstances of both the father and the mother, as well as the mother’s justified needs and expenses. Based on these, it totals the necessary costs and, taking into account the father’s financial capabilities, determines the amount of maintenance.
