What are the 3 basic legal rebuttable presumptions for the establishment of paternity?

1 – the father of the child is the mother’s husband or the mother’s former husband, if the child is born within 300 days of the termination of the marriage;

2 – the father of the child is the man who, together with the mother, makes a joint declaration of his paternity of the child before a court or the registry office;

3 – the father of the child is the man who had sexual intercourse with the mother during the period between 300 and 160 days before the birth of the child.

By when can paternity be denied?

A – the father may deny paternity within 6 months from the day he learned of facts establishing reasonable doubt about his paternity, but no later than the child’s 6th birthday;

B – the mother may deny the husband’s paternity within 6 months of the child’s birth.

The court may waive the missing of deadlines!
