On what basis does the court determine the amount of child support?
The child’s standard of living should, in principle, be identical to that of the parents. In reality, courts primarily rely on the recommendation tables of the Ministry of Justice – link here. For example, the income of a parent’s new partner if they share a household, the parent’s assets, income from business or rent, or the justified needs of the child.
Which court handles child support?
Always the district court with jurisdiction according to the minor child’s place of residence. When filing a petition, no court fee needs to be paid. And child support for a minor can be claimed up to 3 years retroactively!
What is the procedure?
