Did you receive a letter from the court by mail or in your data box containing a payment order? It may concern a debt known to you, but you may just as easily be surprised by what it is about without being aware that you owe anyone anything. If you do not agree with the debt, or the amount of the debt, you can defend yourself against the payment order. We will be happy to help you with that.
How to defend yourself against an electronic payment order?
Do you disagree? File an opposition against the payment order!
The law allows for an opposition to be filed against an electronic payment order within 15 days of its delivery. The period begins to run the day following its delivery. You pay nothing for filing an opposition. By filing an opposition, the payment order is automatically cancelled and the court proceedings continue in the classic way, i.e., by scheduling a court hearing with personal attendance. In the meantime, you can also negotiate with the opposing party.
What must an opposition against a payment order contain?
When drafting an opposition, several things must be kept in mind. Firstly, it is necessary to correctly state the parties to the dispute, the case file number, and the subject of the dispute. Furthermore, the reason why you do not recognize the payment order, or in which part, must be stated. This should be supported by your assertions and evidence. Finally, you must monitor the deadline within which the opposition must be delivered to the court. Your assertions and evidence can then potentially be supplemented during the proceedings, so you do not have to worry about having to state absolutely everything immediately or else lose.
