A divorce concludes once the divorce decree has become legally binding (attained legal force). <\/strong> This means that the judgment can no longer be appealed and it begins to have legal effect.<\/p>

If both spouses have filed a joint petition for divorce proceedings<\/strong>, then it is not possible to file an appeal against the divorce<\/strong> decree. The same applies if the petition was filed by one spouse and the other joined it. In such a case, the divorce becomes legally binding upon the delivery of the judgment to both spouses. <\/p>

Example of a joint petition for divorce becoming legally binding<\/h3>

Petr wanted to divorce his wife Pavla. Despite initial arguments, they were able to reach a reasonable agreement that ending the relationship would be better for both of them. Petr’s attorney filed a petition for divorce on Petr’s behalf.<\/strong> Pavla’s attorney discussed the matter with her client and subsequently sent a joinder to the husband’s petition to the court. At the end of the first court hearing, the judge issued a judgment; this arrived for Petr by mail in 14 days and for Pavla in her data box in 7 days. The divorce thus became legally binding on the day the judgment was delivered to Petr. <\/p>

Becoming legally binding in a contested divorce<\/h2>

In the event that one of the spouses does not want to divorce and the court nevertheless decides to dissolve the marriage, that spouse has the right to appeal the judgment.<\/strong> The appeal must be filed within 15 days of the delivery of the district court’s judgment and is handled by the regional court. Only the decision of the regional court finalizes the divorce proceedings with legal force, and only this decision has legal effect. <\/p>

Example of a contested divorce becoming legally binding<\/h3>

Martina could no longer stand her husband Michal. Therefore, she filed a petition for divorce through her attorney. Michal, however, did not feel any intense negative emotions and did not want to divorce. The district court found that the marriage was irretrievably broken and therefore dissolved it. Michal, however, stood his ground and did not accept the divorce. With the help of his attorney, he appealed the judgment. The regional court reviewed the entire matter and agreed with the district court, confirming its decision. Only upon the delivery of the regional court’s decision to both spouses did the divorce become legally binding and take effect. <\/p>
